Transitioning to the P&C Association

The NSW Department of Education is pleased to announce additional support for Out of School Hours Care (OSHC) providers that are interested in transferring their service to a Parent & Citizens Association, to enable the transition to become a Category A provider.

Background
Following the OSHC provider category review, Category A providers are now limited to Parents & Citizens Associations incorporated under the Parents and Citizens (P&C) Associations Incorporation Act 1976. Category A providers are eligible to receive an eight-year licence renewal when their existing licence agreement terminates. View further information about the provider category review.

The Department has worked closely with the Federation of P&C Associations to develop the support that is available; including a template for an Asset Sale Agreement as well as a grant program to help cover the cost for providers that choose to transition their OSHC service.

Support for providers who wish to transition

Template Asset Sale Agreement
A template Asset Sale Agreement has been developed for OSHC providers. This template can be used to assist with the legal transaction of transitioning an OSHC service. In addition to the template, providers should still seek legal, tax, and financial advice to ensure any specific requirements regarding the transition process are also covered. P&C Transition Grant Program
Providers may apply for up to $10,000 (GST inclusive) to reimburse legal costs directly associated with the transition process, pending eligibility as detailed in the grant guidelines.

Transition Timeframes
Providers that choose to make this transition have until the expiry of their current licence to do so. For existing OSHC licences that expire before 30 June 2025, licences may be extended to 30 June 2025 enable this change.
