Webinar recording
A webinar was hosted by the department on Thursday, 27 June 2024 on the new regulation clause 10B of the Education Regulation 2017 (NSW), the associated updated guidance in the Not-for-Profit Guidelines for Non-Government Schools (2024) (PDF 594 KB) (NFP Guidelines), and how it applies in a variety of non-government school settings.
The new regulation clause 10B and section 9.2 of the accompanying NFP Guidelines (PDF 594KB) content provide regulatory clarity that a non-government school may use certain income and assets to provide recognised education and care programs (including preschool, long day care and out of school hours care programs) without operating for profit.

Coming soon – launch of the preschools on non-government school sites grant program
The NSW Government has committed $60 million to build new or upgrade existing preschools on at least 50 non-government school sites in high-growth areas. The preschool on non-government school sites grant program (the program) aims to improve access to quality preschools in high growth areas, and school sites will be selected based on socio-economic status, student demographics and classification as a special school.
We are excited to inform you that the program will commence soon.
Under the program, eligible non-government schools can apply for grant funding under the two streams:
- New builds: grants of up to $4 million to support major capital works that will build new preschools on selected non-government schools sites and grants for planning purposes.
- Upgrades to existing preschools: grants of up to $350,000 to support minor capital works and grants for planning purposes (for example, building of indoor or outdoor play spaces, renovations to existing facilities and minor expansions).
The program guidelines to be made available on the non-government schools website will provide detailed guidance on the eligibility criteria including the location of high growth areas, section criteria, and application requirements under the program.
The program will be administered by Catholic Schools NSW and The Association of Independent Schools of NSW as ‘Grant Authorities’ on behalf of the NSW Government.
How can I apply?
Non-government schools and/or approved authorities for systems of non-government schools wishing to apply under the Program must apply to their respective Grant Authority.
Schools should engage with their respective Grant Authority once the program launches for more information and support on the application process including opening and closing dates.
How will I know when the program has officially commenced?

Update from the Non-Government Schools Not-for-profit Advisory Committee
It was lovely to see the engagement from key stakeholders and schools alike, during the new regulation clause 10B 'lunch and learn' webinar. The Advisory Committee hopes that attendees left the webinar with an enhanced understanding of how the regulation applies to recognised education and care services. Moving forward, the Advisory Committee will continue to work with the department to promote non-government school understanding and compliance with the not for profit requirements under the Education Act 1990 (NSW) ("Act") and the associated regulations.
