Non-Government Schools Not for Profit Regulatory Framework development and Not-for-Profit Guidelines review
The department is working with key stakeholders to develop an outcomes and risk-based regulatory framework for the not for profit requirements of the Education Act 1990 (NSW) (‘Act’). The department is also supporting the review of the Minister’s Not-For-Profit Guidelines for Non-Government Schools (2019) (the ‘NFP Guidelines’). This is to ensure that they continue assisting non-government schools to comply with the not for profit requirements of the Act.
In October 2022, the department released a public Discussion Paper and held a series of workshops with key stakeholders across 2022 and 2023 to consult on the design of the Regulatory Framework and the NFP Guidelines. The feedback received through these processes was carefully considered and was used to inform the development of the draft Regulatory Framework and updated NFP Guidelines. Call for feedback on exposure drafts of the Regulatory Framework and NFP Guidelines
The department welcomes stakeholder feedback on the exposure drafts of the Regulatory Framework and the NFP Guidelines:
- exposure draft of the ‘Regulatory Framework for the Oversight of Financial Assistance Provided to NSW Non-Government Schools’
- exposure draft of the ‘Not-for-Profit Guidelines for Non-Government Schools’.
Stakeholder submissions can be made during the 5 week consultation period from Thursday 19 October to Friday 24 November 2023.
All submissions should be made in writing and submitted via email to NonGovSchools.RegulatoryFramework@det.nsw.edu.au
Submissions should address the questions below in as much detail as possible:
Q1. Does the Regulatory Framework provide you with a transparent and sufficient understanding of the outcomes and risk-based approach to the oversight of financial assistance provided to or for the benefit of non-government schools under the Education Act 1990?
Q2. Do the revised Not-For-Profit Guidelines assist non-government schools in understanding their obligations in relation to financial assistance provided to or for the benefit of non-government schools under the Education Act 1990?
