Public interest directions

The NSW Privacy Commissioner has renewed the following Public Interest Directions made under s41(1) of the Privacy and Personal Information Protection Act 1998 (PPIPA).

The NSW Privacy Commissioner can make Public Interest Directions under s41 of the Privacy and Personal Information Protection Act 1998 (PPIP Act) and s62 of the Health Records and Information Privacy Act 2002 (HRIP Act). Directions waive or modify the requirement for a public sector agency to comply with an Information Protection Principle (IPP) or Health Privacy Principle (HPP) or a code of practice made under this legislation.

Directions are made for a finite time so it is necessary to check on the IPC website to current Directions.

Directions listed on these sites as current and impacting on the operation of DoE are the Directions on Human Services Dataset which relate to the operation of the Their Futures Matter project.

The directions, made under s41 of the PPIP Act and s62 of the HRIP Act, enable the collection, use and disclosure of personal information, to facilitate the implementation of whole-of-government reforms. These are designed to ensure that effort and funding across government are focussed on interventions that will improve the long-term outcomes of Vulnerable Children or Young Persons and their families at the earliest opportunity.

The directions expire on 13 July 2023.
