Introduction

  • A. The University of New England ("UNE") is a public university located in Annidale in regional New South Wales, Australia.
  • B. SiMERR National Research Centre is an Australian national research centre that works on large-scale national and international projects. SiMERR has a track record of completing high-impact research on education issues associated with rural and regional communities to achieve improved educational outcomes for all students by enhancing professional knowledge and competencies of teachers and school systems.
  • C. The NSW Department of Education ("the Department") is responsible for leading the provision of world-class education in NSW public schools.
  • D. Jeju Special Self-Governing Provincial Office of Education ("Jeju POE") is the office of education governing all educational matters in the province of Jeju in South Korea, including education in schools, professional development for teachers and principals, developing educational policies, and providing visions and directions for school education.
  • E. The Asia ConneXions (www.une.edu.au/asiaconnexions) program connects Australian schools with schools in Korea, Japan, China, and Indonesia using high definition (HD) videoconferencing to enhance students' global thinking, cultural learning, and/or second language learning. The Australia-Korea ConneXion program is the Korean focus of the Asia ConneXions program.
  • F. This MOU sets out the intention of UNE, the Department and Jeju POE to promote the joint activities listed in Clause 1, in particular, the Asia ConneXions Program coordinated by the UNE-SiMERR research team.

Terms

1. Scope of Co-operation

  • 1.1 The purpose of this MOU is to set out how the parties intend to provide global education opportunities for students in New South Wales, Australia, in particular from rural and regional areas, and students in Jeju POE, South Korea, utilising videoconferencing through the Australia-Korea ConneXion program. This program connects Australian students with students in Korea through videoconferencing, e-pals, and, where possible, reciprocal sister school visits.
  • 1.2 The three parties agree to encourage the following activities, through videoconferencing or other activities at a distance, to support the Australia-Korea ConneXion program. These include:
    • 1.2.1 supporting videoconferencing links between NSW public schools and Korean schools (primary and secondary) in Jeju, focusing on cultural learning and/or language learning.
    • 1.2.2 providing information for global education opportunities for schools in NSW and Jeju in order to develop their students' global thinking and global citizenship.
    • 1.2.3 sharing and discussing ideas and information about teacher education and professional development.
    • 1.2.4 collaborating with each other on educational projects that are mutually beneficial.
  • 1.3 Any commitment of resources relating to the implementation of the activities referred to in this MOU will be negotiated by the three Parties and agreed to in a written document prior to commencing the activities.

2. Facilitation

  • 2.1 The cooperation will be overseen by the designated representatives of the Parties.
  • 2.2 At the time of signing this MOU, the designated representative for: UNE is [Name of third party removed]; for the Department is Elisabeth Robertson; and for the Jeju POE is [Name of third party removed].

3. Term of MOU

This MOU is effective for five years from the date of signing or until ended by any of the Parties giving 60 days' written notice at any time to the other Parties, whichever occurs first

4. Variation

Any variation of the MOU must be in writing and signed by all three parties.

5. Relationship

Nothing in this MOU creates an agency, partnership, joint venture or employment relationship between the Parties or any of their respective officers, employees, contractors or agents.

6. Legal Effect of this MOU

This MOU is only intended to express the intentions of the Parties. The expressed intentions are not binding and no legally-binding obligations are intended to, or do, arise as a consequence of the Parties signing of this MOU. Actions taken by any of the Parties in reliance on this MOU will be at that Party's sole risk.

7. Disputes

The parties agree to use their best endeavours to resolve any disputes between them.

8. Counterparts

This document may be executed in any number of counterparts and, if so, the counterparts taken together constitute one and the same instrument.

9. Entire Agreement

This MOU constitutes the entire agreement between the Parties as to its subject matter and supersedes all prior understandings or agreements between the parties. For the avoidance of doubt, this MOU supercedes the MOU dated 11 May 2017 between Jeju POE and UNE.
