Development application notifications for neighbouring developments (responding to)

The Department of Education responds to development application notifications for proposed developments that are likely to impact on the operation of a school or TAFE facility and/or affect the health and safety of students, staff and the school or TAFE community.

1. Objectives - Policy statement

1.1

The Department of Education and Training responds to development application notifications for proposed developments that are considered likely to impact on the operation of a school or TAFE facility and/or affect the health and safety of students, staff and the school or TAFE community.

2. Audience and applicability

2.1

This policy is applicable to all Schools and TAFE Institutes

3. Context

3.1

The Department of Education and Training responds to development application notifications for proposed developments that are considered likely to affect the health and safety of students, the school or TAFE community and staff.

3.2

Schools, TAFE Colleges and the Department of Education and Training receive development application notifications from local Councils for nearby properties or premises.

3.3

If the proposed development is considered of an objectionable nature and incompatible with the operations and safety of an education establishment or office accommodation, e.g. a brothel, methadone clinic, hotel, tavern, extraction industry, development with high traffic volume, etc, or is likely to cause difficulty with the normal functioning of the education facility then an objection should be forwarded to the appropriate consent authority.

4. Responsibilities and delegations

4.1 Regional Directors or School Education Directors

4.1.1

Regional Directors or School Education Directors will, if appropriate, support School Principals when Principals are responding to development application notifications that are considered likely to impact on the operation of a school facility and/or affect the health and safety of students, staff or the school community.

4.1.2

Regional Directors or School Education Directors may independently respond to development application notifications that are considered likely to impact on the operation of a school facility and/or affect the health and safety of students, staff or the school community.

4.1.3

Regional Directors or School Education Directors should, if required, seek advice from their local Asset Management Unit as soon as the development application notifications are received and well before the closing date of the notification.

4.2 Institute Directors

4.2.1

Institute Directors are responsible for responding to development application notifications that are considered likely to impact on the operation of a TAFE facility and/or affect the health and safety of students, staff or TAFE community.

4.2.2

Institute Directors should, if required, seek advice from their local Asset Management Unit as soon as the development application notifications are received and well before the closing date of the notification.

4.3 School Principals

4.3.1

School Principals are responsible for responding to development application notifications that are considered likely to impact on the operation of a school facility and/or affect the health and safety of students, staff or the school community.

4.3.2

School Principals and school community representatives may independently respond to development application notifications that are considered likely to impact on the operation of a school facility and/or affect the health and safety of students, staff or the school community.

4.3.3

School Principals should, if required, seek advice from their local Asset Management Unit as soon as the development application notifications are received and well before the closing date of the notification.

4.3.4

School Principals should notify their School Education Director if a received development application is deemed contentious.

4.4 Regional Asset Management Units

4.4.1

Regional Asset Management Units are responsible for providing advice, regarding development application notifications and proposed objections, to Regional Directors, Institute Directors, School Education Directors and School Principals.

5. Monitoring, evaluation and reporting requirements

5.1

The Director, Asset Planning and Support will monitor this policy and will report annually, or as required, to the General Manager, Asset Management.
