Register of published enforcement actions
The NSW ECEC Regulatory Authority publishes information relating to enforcement actions taken in response to confirmed non-compliance with the National Law, including cancellations, suspensions, prosecutions, enforceable undertakings, compliance actions and emergency action notices.
The register of enforcement actions lists all publishable enforcement action taken by the NSW Department of Education under the Children (Education and Care Services) National Law and the Children (Education and Care Services) Supplementary Provisions Act 2011 (NSW). This register will be updated every quarter, and information will be available for a period of 5 years from publication.
Enforcement action information is only published after all review periods are complete. The register will only identify an approved provider, service name and location and/or nominated supervisor in line with National Law requirements. Individuals will not be named except where it is permitted by law (as is the case in prosecutions).
Types of enforcement actions
An enforceable undertaking is a written direction from a person, in which the person sets out what they will do or refrain from doing, to comply with the National Law and Regulations.
Resolved enforceable undertakings remain listed in the register of published enforcement actions as a historical record.
A compliance notice is a written notice issued by the regulatory authority requiring an approved provider to rectify a substantiated breach of the National Law or National Regulations within a specified timeframe of not less than 14 calendar days. The compliance notice sets out the steps that need to be taken to address the breach.
Resolved compliance notices remain listed in the register of published enforcement actions as a historical record.
An emergency action notice is a written notice setting out steps the approved provider must take to remove or reduce an immediate risk to the safety, health or wellbeing of a child or children being educated and cared for by the service within a specified timeframe of no more than 14 calendar days.
A regulatory authority can only issue an emergency action notice if it is satisfied a service is operating in a manner that poses, or is likely to pose, an immediate risk to the safety, health or wellbeing of a child or children being educated and cared for by the service.
Resolved emergency action notices remain listed in the register of published enforcement actions as a historical record.
A suspension or cancellation of a provider approval means all services held by the provider, in any jurisdiction, are also suspended or cancelled.
Unless the regulatory authority is satisfied that there is an immediate risk to the safety, health or wellbeing of children, a show cause notice will be issued allowing the approved provider to tell their version of events and explain why the regulatory authority should not take this action.
Approved providers who are cancelled or suspended are listed on this page under their legal name. If providers have another name registered as their business name (as the name associated with their early childhood education and care business), these will be incorporated into the list of cancellations or suspensions since 1 January 2024 (updated in 2025).
Register of enforcement actions
The register of enforcement actions provides a historical record of the publishable enforcement actions issued by the NSW ECEC Regulatory Authority from April 2025 onwards.
Details of providers, nominated supervisors and other individuals who have pled guilty to, or who have been found guilty or convicted of offences under education and care services legislation are published separately under Prosecutions.
