Jenny's Kindergarten Early Learning Centre in Bathurst shut down due to serious child safety concerns

The NSW Early Learning Commission has cancelled the provider approval for Jenny's Kindergarten and Early Learning Centre in Bathurst CBD due to ongoing non-compliance and child safety risks.

On Tuesday, the provider, C & J Corporation Pty Ltd, was given two weeks’ notice of the cancellation decision, following a sustained history of persistent poor quality, repeated non-compliance with the National Law and Regulations and unacceptable risks posed to children. As a result, the service will permanently close on 13 October 2026.

Families have been notified of the decision and offered support in finding alternative care.

Since opening in 2014, the Bathurst service has been visited by Authorised Officers 14 times, resulting in 41 compliance actions and 126 confirmed breaches.

Last month, the Approved Provider was fined $9,240 for breaches related to premises, furniture and equipment not being safe, clean and in good repair, including excessive debris and rubbish, cobwebs, and exposed electrical cords.

Other key concerns related to the service include:

  • Failure to protect children from harm and hazards, such as sharp and pointed objects found in garden beds
  • Staff in possession of a personal device, and
  • Failure to conduct appropriate risk assessments before excursions.

While the Commission has worked closely with the provider and service to improve quality over recent years, subsequent visits continued to identify unresolved issues, prompting decisive action in the best interests of the children.

There is no current evidence to suggest that any child has been involved in a specific incident which has caused them direct harm. However, we remain concerned about the level of risk that children are exposed to at this service due to ongoing non-compliance by the provider, which has led to the cancellation decision.

Until the service closes, the Commission will continue unannounced visits and compliance checks to help manage and minimise the risks to children’s safety.

This cancellation decision follows earlier actions involving other Jenny’s Kindergarten services across NSW, with 12 of 15 early learning centres transferred to new providers this year after a history of non-compliance.

Families that need support to find an alternative service can visit the Starting Blocks website or contact the Commission’s Information and Enquiries team on 1800 619 113 or information@earlylearningcommission.nsw.gov.au.

Please attribute to NSW Early Learning Commissioner Daryl Currie:

“The safety and wellbeing of children is our highest priority. Despite ongoing support and opportunities for improvement, the persistent non-compliance of this provider left us with no choice but to take decisive action to protect the children in our care.”

"We understand some families will be impacted by the closure of the Bathurst service, and we are committed to supporting them in finding safe, quality alternative care for their children."

"There is no excuse for failing to provide a safe and clean environment for children. Every early learning provider has a responsibility to meet the highest standards of care, and when they fall short, we must act to protect children and uphold community trust."
